SERVICES OFFERED BY THE WEBSITE

To access the services, registration on the website is not required. Products can be purchased even in “guest” mode by entering billing and shipping details during payment. For those who wish, registration is available on the payment page. During registration, users will be asked to create a username, and an email will be sent to set up the access password.

Only purchases made by private users will be subject to the rules applicable to consumers.

All product prices displayed on the website are in euros and include VAT. Product prices may be subject to periodic changes.

The shipping costs will be updated at the time of the order.

PAYMENTS

The customer may purchase products online and make payments by credit card (Visa or MasterCard), through the PayPal network, or by bank transfer, as indicated on the website, following the instructions for the purchase process. The necessary payment information will be transmitted, via encrypted protocols, to the payment institution entrusted by Engisa Musa with the electronic payment services, with no possibility of access by third parties. Payments must be made in advance, and only after payment will the selected itemswill be shipped.

For payments by Bank Transfer, shipping will begin only after the funds have been credited, and consequently, delivery may be delayed by 2-3 days, plus the shipping time. In this case, it is also necessary to include the order number in the payment reference to identify the transaction. The invoice will be sent by email at the time of shipment.

SHIPMENT

The delivery of products purchased usually takes place within 3-5 business days from receiving the order. The delivery times apply to most of the national territory; for deliveries outside Italy, shipping costs and delivery times may vary. Islands and more remote areas may require two or more additional working days.

The order should be considered incomplete until payment is received.

Payments received after 18:00/10:00 will be considered as received on the next business day. Business days are from Monday to Friday, excluding January 1st, January 6th, April 25th, May 1st, June 2nd, August 15th, November 1st, December 8th, December 24th, December 25th, December 26th, December 31st, and Easter Monday.

Engisa Musa will not be responsible for any damages caused by delays in delivery.

RIGHT OF WITHDRAWAL

In the case of a return for withdrawal, the shipping costs for the return of the products are the responsibility of the final customer. The return will remain under the responsibility of the final customer until the package is delivered to our warehouse. The right of withdrawal is excluded in the cases described in Article 59 of the Italian Legislative Decree No. 206/2005 (Consumer Code), and particularly in the case of sealed goods that cannot be returned for hygienic reasons or for health protection purposes once opened after delivery.

For a return to be authorized for withdrawal of products that meet such requirements, especially with reference to cosmetic products, the items must be returned intact meaning unused and unopened.

To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by means of an explicit statement (e.g., a letter sent by email), including the following information:

To comply with the withdrawal deadline, it is sufficient for you to send the communication regarding the exercise of the right of withdrawal before the end of the withdrawal period, which is within 7 days from the product delivery date.

Effects of Withdrawal

Engisa Musa will not be liable to the user for any damages of any kind, whether direct or indirect, arising from any errors in the goods, of any nature, except in cases of fraud or gross negligence.

At the time of delivery, the user is required to carefully examine the products received. Any defects in the delivered goods and errors in the packaging of materials not attributable to the user must be immediately reported to the courier. The goods must be accepted with a specific “subject to inspection” signature. The user must then open a complaint via email, making sure to include the order number and photographic documentation, where required, within 8 days of receiving the goods. Engisa Musa will make every effort to respond to complaints within 48 hours.

Returns and Reimbursements

The goods must be returned intact, complete with all its parts, and in the original packaging (bags and boxes), kept and possibly used only for the time strictly necessary to establish and verify its nature, characteristics, and size, with normal diligence, without any signs of wear, in compliance with the following conditions:

  • The right of withdrawal may apply to the product purchased in its entirety.
  • For the withdrawal to be possible, the product must be intact, clean, odorless, without removing the anti-theft device, and returned in its original packaging, complete with all its parts (including packaging, any documentation, and accessories: labels, tags, seals, etc.).
  • The right of withdrawal cannot apply to products that the customer has requested to be personalize

REFUND

The return will be processed within 14 working days from the date of delivery to our warehouse. The timing may vary due to transportation delays in the event of holidays or force majeure; however, we want to reassure you that we will continue to make every effort to minimize these delays. We reserve the right to process the refund of the item only after conducting the necessary quality checks or, in the case that the product was returned due to a defect, verifying the actual non-conformity declared by the final customer.

All payments made for the returned items will be refunded, including delivery costs if the buyer chooses to use the courier proposed by the Seller, provided that we will charge you for any decrease in the value of the product, refunding only the residual value of the product in such cases.

The refund process typically takes 14 days from the inspection of the item. Refunds will be made using the same payment method used for the purchase (credit card, PayPal, or bank transfer).

RETURN FOR FAULTY OR INCORRECT PRODUCT

Engisa Musa is committed to providing quality products. If, for any reason, you find defects in the materials or workmanship of the purchased product, please contact our Customer Service, and we will be happy to assist you as soon as possible. Please note that the warranty does not cover damage caused by normal wear and tear or improper maintenance of the product.

In the case of a return for an incorrect, damaged, or faulty product, shipping costs will be covered by us. We will refund both the value of the purchased products and the delivery charges incurred for the order, if the returned product was the only item in the order. Additionally, no return shipping charges will be applied.

To request a refund, you must report it via email to info@engisamusa.it. Please specify the reason as “Damaged product, non-compliant or incorrect shipment,” attaching one or more images of the product in question, clearly showing the defect.

Once the process is completed, you will receive a confirmation email for the return and all instructions for the shipment.

Authorization to return the product does not constitute an acknowledgment of non-compliance, the existence of which will need to be verified by us after the return.

We reserve the right to proceed with the refund of the faulty item only after performing the necessary quality checks to confirm the actual non-compliance of the returned product.

If the product’s non-compliance is confirmed, we will process the refund using the same payment method used for the purchase (credit card, prepaid card, PayPal, etc.) or via bank transfer.

LEGAL WARRANTY OF CONFORMITY

In the case of defects and/or non-conformity, you are entitled to have the product brought into conformity through repair or replacement, or alternative remedies as expressly provided by Italian Legislative Decree No. 206/2005 (Consumer Code).

If you have received a damaged, non-compliant, defective, or incorrect product, you can request a repair, replacement, or refund of the item. In accordance with European Directive 771/2019/EC and the Consumer Code, the products you purchased are covered by the legal warranty of conformity, which covers product conformity defects for a maximum period of 24 (twenty-four) months from delivery, provided that your action to assert the above-mentioned conformity defects is subject to a limitation period of 26 months from delivery.

APPLICABLE LAW, JURISDICTION, AND COMPETENT COURT FOR NON-CONSUMER USERS

These Terms and Conditions are governed by Italian law.

For all orders placed by parties who do not qualify as “consumers”” all disputes related to the interpretation and/or execution of this contract will be exclusively subject to the jurisdiction of the Court of Rome.
